1. In these Terms and Conditions:
‘The Invoice’ means the confirmation document setting out the terms of the hire
‘The Company’ means Blackmore Commercials Ltd
‘The Contract’ means these Terms and Conditions and the Invoice
‘The Hire’ means the hire of the vehicle/vehicles by the hirer for the agreed date and journey.
‘The Hirer’ means the person, firm or company contracting with the Company to hire the vehicle
‘The Vehicle’ means the Routemaster bus RML, RM, RTL, RF or London Taxi, Rolls Royce or another vehicle referred to on the invoice.

2. APPLICATION

These conditions apply whether a contract has been made verbally or in writing.
The hirer acts on behalf of all passengers travelling on the vehicles, if the hirer is a company, group or partnership an individual must be named as a responsible person. The hirer is responsible for the actions and decisions of all the passengers on board including any additional costs incurred in performing the contract whether or not they actually travel with the party. If the hirer is not going to travel with the party a representative must be chosen and the company will only accept instructions from the hirer or their nominated representative. Where a copy of these conditions has been given to the hirer at any time or the hirer has been advised verbally of all significant terms making the booking will be deemed to signify acceptance of them.

3. QUOTATION

Quotations are given subject to the company having a suitable vehicle at the time the hirer accepts the quotation and on the basis of the direct route and on information provided by the hirer. The route used will be at the discretion of the company unless it has been specifically specified by the hirer and agreed by the company in which case it will be clearly stated on the invoice. The company will deliver passengers as near to the stated destination as possible subject to any restricted access encountered.
Quotations are valid for 90 days unless otherwise notified.
Quotations are given for the bus, driver and conductor only. Any additional charges will be separately identified and will be the hirer’s responsibility unless otherwise specified. It is the responsibility of the hirer to ensure that access is possible to the collection and destination points especially when hiring the London buses.

4. USE OF THE VEHICLE/PERSONAL BELONGINGS

The hirer cannot assume the use of the vehicle between outward and return journeys, nor that it will remain at the destination for the hirer’s use unless this has been agreed with the company in advance. The company will not be held responsible for the safekeeping of any of the hirer’s or passengers personal belongings which should not be left on the bus.

5. SMOKING

Smoking and vaping is strictly prohibited at all times in any of the Company’s vehicles.

6. FOOD & DRINKS

Food and drink will not be allowed on the vehicle unless it is agreed with the company prior to the hire. Any beverages must be consumed in plastic, cans or cartons. A spillage charge of £50.00 + VAT will be charged if the seats have to be cleaned.
A soilage charge of £65.00 + VAT will be charged if a passenger is ill on the bus or any of the other vehicles.
The company expects that the hirer will respect the Vintage vehicle supplied.

7. ROUTE AND TIME VARIATION

The vehicle will depart at times agreed by the hirer and it is the responsibility of the hirer to ensure that all passengers are accounted for at the specified departure time. The company will not accept liability for any losses incurred by passengers who fail to follow the instructions given by the hirer.

8. DRIVERS HOURS

The hours of operation for the driver are regulated by law and the hirer accepts the responsibility of ensuring that the hirer keeps to the hours and times agreed by the company. Neither the hirer nor any passenger shall delay or otherwise interrupt the journey in such a way that the driver is at risk of breaching regulations relating to driving hours and duty time. If any breach is likely to occur the hirer will be responsible for any additional costs incurred unless it is out of control of the hirer.

9. SEATING CAPACITY

The Company will at the time of booking agree and specify the legal seating capacity of the vehicle to be supplied. The hirer must not attempt to load the vehicle beyond this capacity.

10. CONVEYANCE OF ANIMALS, BICYCLES, PUSHCHAIRS AND WHEELCHAIRS

No animals other than guide dogs and hearing dogs may be carried without prior agreement with the Company in advance.
Bicycles are prohibited.
Pushchairs and wheelchairs will need to be folded on board and the hirer should be aware that this may reduce the stated seating capacity, the hirer is to allow for this when accepting the Company’s quotation.

11. PAYMENT

Any non refundable deposit received will secure the booking, the balance is due to be paid 28 days prior to the hire and a subsequent invoice will be issued for this amount in advance.
Payment can be made by card, cash, cheque or bank transfer. The vehicle will not depart from the Company base if the balance has not been paid.

12. CANCELLATION BY THE HIRER

If the hirer cancels the bus after the balance has been paid it is at the Company’s discretion if any portion of a refund is made.

13. CANCELLATION BY THE COMPANY

In the event of a cancellation by the Company a full refund will be made unless items 14 and or 15 take effect.

14. WEATHER CONDITIONS

The Company reserves the right to cancel the booking if the weather conditions make the booking unsafe for the vehicle and passengers to continue to the destination. Flood, snow, ice and other forces of nature are beyond the control of either party. The Company will endeavour to continue the journey as far as possible or cancel the booking if the weather is too dangerous to continue. No refund will be offered unless as a gesture of goodwill.

15. VEHICLE BREAKDOWN

In the event of a vehicle breakdown the Company will use its best endeavours to transport passengers onward to their destination or back to their original pick up point. However the hirer agrees that the Company will not be held liable for any delays or disruption and any consequential costs arising from such delays or disruption caused by such a vehicle breakdown. The Company will try where possible to find a replacement vehicle if the booked vehicle is not available due to a breakdown.
